UK Splash Class Association Rules
TITLE The association full title
shall be The UK Splash Class Association and referred to as UKSCA in this document.
2. OBJECTS
The objects of the UKSCA are to
promote the class and represent the interests of owners in the UK as follows:
2.1 To govern and promote the sailing and racing of the Splash/Flash
dinghy class ('The Class') in the UK.
2.2. To co-operate with the builders
and the design copyright holders in the dissemination of information regarding
the class rules and proposed changes to these.
2.3. To co-ordinate
a programme of races throughout the UK, including a National Championships.
2.4. To establish and maintain a working relationship with other national Splash Class
associations and the international class association if any, with a view to interchange
of ideas and co-operation in arranging international events.
2.5. To
represent the interests and negotiate on behalf of members of UKSCA in respect
of class and measurement rules with the international class association.
2.6. To maintain a register of boat numbers and owner / member names.
3.
MEMBERSHIP
3.1. There are four types of membership:
3.1.1. FAMILY MEMBERSHIP is open to all members of a family, who are normally
resident at the same address, on payment of the appropriate membership subscription.
Family membership is available until the end of the year in which the youngest
family member reaches the age of eighteen. Each member of the family sailing a
Splash/Flash (limited to the number of Splash/Flash dinghies owned by the family)
is deemed to be an Ordinary Member.
3.1.2 INDIVIDUAL MEMBERSHIP is open to any person on payment of the appropriate membership subscription. Such
members are deemed to be Ordinary Members.
3.1.3. HONORARY MEMBERSHIP. UKSCA may, on the recommendation of the Committee, elect honorary members for
a fixed term, or for life, at any General Meeting.
3.1.4. ASSOCIATE MEMBERSHIP. The Committee may accept applications, from individuals or family groups for whom
other classes of membership may not be appropriate, for Associate Membership on
payment of the appropriate membership subscription.
3.2. Members shall
comply with the UKSCA rules and any refusal or neglect to do so or any conduct
that in the opinion of the Committee is either unworthy of a Member or otherwise
injurious to the interests of the Association, shall render a Member liable to
expulsion by the Committee. Before expelling a Member, the Committee shall call
upon him/her for an explanation of his/her conduct and shall give him/her an opportunity
of defending himself/herself or of resigning his/her Membership. The vote on a
resolution for expulsion shall be by ballot and the resolution shall only be carried
if not less than three-quarters of the members of the Committee present vote in
favour of the resolution.
3.3. Only Ordinary Members are eligible to
participate in sailing events organized by the UKSCA. When sailing in races, which
consist of or include the class, they shall ensure that their boat complies with
the measurement rules.
3.4. Any member may attend and participate in
General Meetings. Only Ordinary Members may vote at such meetings. This applies
equally to postal ballots.
3.5. Each Family, Individual, Associate
and Honorary Member is entitled to receive one copy of each issue of the Class
newsletter.
4. MANAGEMENT.
4.1. The Committee
shall manage the affairs of UKSCA.
4.2. The committee shall consist
of not less than 6 nor more than 12 Ordinary Members of the UKSCA, age 16 or over,
who shall be elected annually by a general meeting.
4.3. The committee
shall have the power to co-opt additional persons to the committee. Co-opted members
do not have voting rights on the committee.
4.4. The committee shall
have the power to form sub-committees (which may include co-opted members), the
terms of reference for which shall be set by the main committee. Chairmen of the
sub-committees shall be appointed by and from the main committee and will report
to main committee on behalf of the sub-committees. Sub-committee decisions are
subject to review and ratification by the main committee.
4.5. Members
may serve on the committee
4.6. If a vacancy arises on the committee
during its term of office, the committee may, at their discretion, co-opt as in
4.3 above. In this situation co-opted members have full voting rights on the committee
and their term of office is the same as the person whom they have replaced. The
committee will co-opt as above should the number of committee members drop below
the minimum defined in the UKSA rules.
4.7. At its first meeting the
committee shall carry out the following.
4.7.1. Elect a chairman for
the term of office of the committee.
4.7.2. Elect a vice-chairman for
the term of office of the committee.
4.7.3. Elect a secretary for the
term of office of the committee. The secretary shall be responsible for keeping
minutes of all committee and general meetings and a register of owners. The secretary
will also be responsible for communication between the committee and the members
and any other outside organizations.
4.7.4. Elect a treasurer for the
term of office of the committee. The treasurer shall be responsible for the funds
of UKSA and shall keep accurate records of all financial transactions and shall
submit accounts to the annual general meeting for approval.
4.7.5. Elect other posts essential for the management of the UKSCA, e.g. Sailing Secretary,
Training Officer, Social Secretary. Measurer, Technical officer, Publicity Officer,
Sponsorship Officer, and so on.
5. POWERS AND CONDUCT OF
THE COMMITTEE.
5.1. The committee is empowered to perform all functions
of administration and financial control of UKSCA and shall report its activities
to the annual general meeting. The committee shall also carry out all tasks which
the annual general meeting shall resolve, provided these resolutions are properly
voted upon and in accordance with the UKSCA rules.
5.2. The quorum
for committee meetings shall be one-third of the members with a minimum number
of 4.
5.3. The secretary shall notify each committee member of the
date, time and place of a committee meeting by post or by e-mail at least two
weeks in advance of the meeting. The committee may conduct business by post or
by e-mail and should any member fail to signify his or her views within two weeks
of the date of posting or by e-mail it will be assumed that he or she is in agreement
with the motion.
5.4. The treasurer shall have the power to make payments
on behalf of UKSCA, provided these do not exceed £250. Payments in excess of this
figure shall only be made if a second signature is obtained. Other signatories
shall be the chairman and the secretary.
5.5. The committee shall have
the power to make recommendations to the membership in respect of alterations
or additions to the UKSCA rules. Only a general meeting of UKSCA, as defined in
section 6, has the power to change the UKSCA rules.
5.6. The committee
shall, if requested by the membership, arrange an annual championship and other
sailing events. The committee shall liase with the host club, the RYA and any
other appropriate body in respect of this. The committee shall also cooperate
with the International Class Association in respect of staging international events.
6. MEETINGS OF THE ASSOCIATION.
6.1. The annual
general meeting of UKSCA shall take place at a suitable venue and time, to be
fixed by the Chairman and must be notified to the members at least 28 days in
advance..
6.2. The committee may, on giving the members at least 14
days notice, call a special general meeting.
6.3. The committee shall,
at the written request of at least 10% of, or a minimum 10, Ordinary Members and
giving the required notice, call a special general meeting.
6.4. At
a general meeting the quorum shall be 10% of the membership or a minimum of 12
voting members. The meeting will be chaired by the UKSCA chairman or, in his absence,
the vice-chairman or, in his absence, a deputy appointed by the committee.
6.5. At a general meeting, decisions shall be restricted to matters which have been
notified, in writing, to the class secretary at least 14 days before the meeting.
Voting shall be on the basis of a simple majority (of those present and eligible
to vote) and may be by show of hands or by poll if at least five members so request.
The chairman shall have a casting vote. In the case of matters concerning the
UKSCA rules, a majority of two-thirds (of those present and eligible to vote)
is required.
7. SUBSCRIPTIONS.
7.1. The level of
subscription for membership shall be decided at the annual general meeting. Payment
shall become due on 1st January each year. A member joining UKSCA after 1st September,
having paid a subscription for that year shall not be required to pay a subscription
for the following year.
7.2. Any member who does not pay his or her
subscription within three months of the due date shall have his or her name removed
from the register and immediately looses all rights and privileges afforded to
UKSCA members, including participation in sailing events and voting rights at
general meetings. A member's name may be restored to the register at the discretion
of the committee and upon payment of the due subscriptions and any arrears owed.
7.3. Measurement certificates are only valid when held by paid up members
of the association.
8. FINANCE.
8.1. The UKSCA
treasurer shall keep records as defined in section 4 and in addition shall ensure
that an annual financial statement is presented to the members at the annual general
meeting.
9. ONE-DESIGN STATUS OF THE CLASS.
9.1. The Splash class is a strict one-design and the association and committee shall
assist in the protection of this design and report to the international association
or the design copyright holder any matter which appears to violate the class rules.
9.2. The Splash dinghy is imported into the U.K. by agents, who are
licensed by the copyright holder.
9.3. The copyright holder issues
each Splash dinghy imported by the UK agent with a sail number, after payment
by the UK agent of a license fee. Upon completion, the UK agent shall issue a
measurement certificate to the purchaser. The builder shall notify the secretary
of the name and address of the owner.
9.4. When a boat changes hands,
the measurement certificate is invalidated and a replacement is issued to the
new owner on joining UKSCA (section 7.3 refers). It is not necessary for the boat
to be re-measured.
